EPAP Ukraine acted as a pro bono legal advisor to the Ministry of Justice of Ukraine on implementation of the pilot public-private partnership (PPP) project.
The team, which includes Senior Associate Kateryna Oliynyk and Associate Oleksii Latsko and is led by Partner Roman Stepanenko, advises the Ministry of Justice of Ukraine on the development and structuring of the pilot PPP project with respect to the construction of a new pre-trial detention facility in Kyiv and Lviv and a hospital ("Project").
Legal advice covered, among other, compliance issues and procedures of PPP project implementation, allocation of risks, rights and obligations between public and private partner.
As a result of the cooperation between parties, the Ministry of Justice of Ukraine and other government and local authorities, as well as the Norwegian Correctional Service signed a Memorandum of Cooperation for the purposes of development and implementation of the Project.
In early February, the Ministry of Justice of Ukraine initiated the call for proposals on cooperation from investors in accordance with the Law "On Public-Private Partnership".
"Currently, our team is involved in PPP projects in several post-soviet jurisdictions, and previously used to work on the foundation of PPP regulatory framework in Ukraine. For that reason, we offered our knowledge and expertise to the Ministry of Justice and the National Reforms Council for initial legal analysis of this project. We believe that the project whenever implemented will be a pilot one lightning up the way for new social and infrastructure initiatives." – commented Roman Stepanenko.
